Employment Law | The Issue Of Discrimination In The Workplace

In this case, the Fairview County Public Library is focused on implementing the affirmative action plan in order to increase the number of male supervisory librarians, considering gender as one of the key components of the decision making aimed at promoting librarians. It is clear that this affirmative action plan designed by the library would be valid under the law. As a rule, affirmative action plans are aimed at increasing the utilization of minorities (African Americans, Latinos, Native Americans, etc.), women, and persons with disabilities, and the Vietnam era veterans in various job categories affected by discrimination in the workplace. According to experts, affirmative action plan helps to overcome the lingering effects of discrimination in the workplace. It is clear that there are no men in the list of categories of employees that have been historically victimized by discrimination. Under Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e et seq., employment discrimination on the basis of race, color, religion, sex, or national origin is prohibited.  The US Supreme Court has held that Title VII of the Civil Rights Act of 1964 does not prohibit all types of race-conscious actions taken voluntarily by employers. Employers must demonstrate that their affirmative action plans are adopted to correct “manifest imbalances in their workforces and that the measures used to accomplish this do not unnecessarily infringe on whites or males” (Walsh, 2012, p. 263). In this case, the library is focused on making improvements in employment practices to promote equal protection opportunities of male employees. As the study of the library staff shows that 3 out of 30 supervisors in the library branches are male, although men make up 25% of the branch librarians, there is a need to address this problem immediately. If this problem is caused by past discriminatory practices against male employees, it is necessary to improve the situation. Thus, the affirmative action plan can help to provide analysis of the current problems and barriers that should be removed. In addition, the affirmative action plan can help to improve employment practices and promotion process that discriminate employees on the basis of gender.
