Juvenile Justice System Essay

All people are to live in societies, it means that they need to co-exist and be able to interact normally. In order to organize this interaction in the proper way, it is necessary to foresee laws and regulations. Young people also belong to the society and certainly they also need to subdue to some rules and norms of behavior. Unfortunately the issues of juvenile delinquency are rather sophisticated and controversial.

Before the twentieth century the justice system for adult people and for youngsters was more or less equal. Juveniles were to go through the same punishment, as adult people, even including death penalty. However, in the twentieth century the situation started to change and punishment for children and young people was reconsidered. Even the term “criminal” was substituted with “delinquent child”; new courts for juvenile justice started to appear. (Howell 2003). These factors were the results of the reconsideration of the main reasons for committing crimes by children and teenagers, which were seen as the signs of lack of care and control of their parents. In addition, the researchers came to conclusion that before juveniles committed more serious crimes, it was necessary to take certain steps to improve the situation. Finally the two justice systems were created, splitting the issues of adult people and children. Punishment, retribution, rehabilitation and other issues also differentiate. This is evident, that taking into consideration the main aims of juvenile delinquency, there is a lot of further research is needed. Such issues as the causes and conditions of juvenile delinquency, methods of treating children, ways of adjusting punishment and making rehabilitation maximum efficient have been already studied and still remain controversial.

Overall, justice system for children should certainly differentiate from general rules and regulations and be maximum effective for regulating of young children’s behavior, at the same time being based not on punishment, but rather on support and rehabilitation approaches.
