How a Bill Becomes a Law

SITUATION: IS THIS SOMETHING THAT CAN BE LEGISLATED?

  • Identify the problem/concern:  Today, the problem of the workplace violence that affects nurses becomes more and more challenging as cases of violence against nurses in their workplace environment become more and more frequent. In such a situation, nurses remain unprotected since just a part of cases of violence are reported and, therefore, investigated, while even fewer cases result in punishment of offenders. The problem occurs because of poor reporting and the lack of legal procedures to investigate every case of violence and respective investigation of each case on the ground of the report filed. Now, only acts of violence with intent are reported. As a result, nurses remain vulnerable to violence and have little opportunities to protect them not only physically but also legally.                                                                                                                                                                                                                                                                                                                                                                                      
  • State your proposal/idea. The proposed idea is the introduction of obligatory reporting of every case of violence in relation to nurses, regardless of whether the violence had any intent or not. The obligatory reporting will increase the legal liability for violence against nurses. If every case of violence is investigated, offenders will face the higher risk of punishment. The awareness of the possible punishment will discourage individuals from violence against nurses.                                                                                                                                                                                                                                                                                                                                                                                               

BACKGROUND: DO YOUR RESEARCH

  • Include studies, reports, personal experience, or anecdotal stories related to your proposal.  S. Trossman (2011) reveals the problem of the violence against nurses. She reveals the fact that the problem is common for nurses nationwide. At the same time, different states have different regulations concerning reporting cases of violence against nurses, but the obligatory reporting of any case of violence against nurses is still not fully implementing in either state. In this regard, the lack of the legislative ground creates conditions for the persisting violence against nurses. P.F. Cipriano (2016) admits that the problem of violence against nurses persists and threatens to the safety and health of nurses. She argues that the safety of nurses is not just the matter of the physical or legal protection of nurses but also it is the matter of patient safety because no one can feel safe in the environment, where nurses are exposed to the threat of violence. S. Hester and colleagues (2016) recognize that the problem of violence against nurses does exist and suggest recommendations to prevent and manage the problem effectively, including the enhancement of the administrative control and provision of nurses with counseling services, if they suffered violence at the workplace.                                                                                                                                                                                                                                                              
  • Has there been similar legislation introduced and/or passed in other states? If so, include it. Similar initiatives have emerged in Arizona, Virginia, but nurses have reached little progress so far in the legal enhancement of nurses’ protection and enhancement of the legislation is still needed.                                                                                                                                                                                                                                                                                 

ASSESSMENT: FINANCES AND STAKEHOLDERS

  • Identify financial impact if any (e.g., added costs, cost savings, increased revenue): The prevention of the problem of violence against nurses will have a positive financial impact. First, nurses will stay at work and keep working as they have to, while, if they suffer from violence, they have to take a medical leave and they need rehabilitation. Moreover, nurses vulnerable to violence in their workplace environment are not capable to perform well.                                                                                                                                                       
  • Identify stakeholder groups that would support this bill: Nurses and medical staff will support the bill along with the association of nurses, such as ANA.                                                                                                                                                                                                       
  • Identify people/groups that would oppose this bill: Patients and insurance companies may oppose to the bill because of the risk of false allegations and enhancement of the authority of nurses, in case of reporting of any violent case and its investigation.                                                                                                                                                                                                         

RECOMMENDATION

  • Make an appointment with your legislator to discuss your proposal. The recommended solution to the problem of the violence against nurses is the introduction of the obligatory reporting that will follow up by the investigation of every case to discourage potential offenders from abusing nurses.
