The Mediation Process Essay

Introduction

A man is a social being. Therefore, it is expected that conflicts have to ensure once in a while in life. There also have to means of solving these conflicts and ensure that there is unity among the people. To resolve disputes, there must be precise ways which are followed to ensure that conflicts are solved. Among the known means of conflict, resolutions are mediation whereby disputes are settled through the involvement of a third party (Chan, 2014 pg.46). This third party becomes the go-between allowing the two parties to reach a consensus by allowing the two sides to lay down their views and use these to solve the case.

Mediation has come in handy on my side on some occasions. There is this particular time I had conflicted with my mother about the responsibilities I used to be given to my sisters. I was in high school, and they were younger than me. My mother was a busy woman. Hence she had very little time to stay with the family. Being the eldest child, I was supposed to take care of my sisters and prepare them dinner and breakfast before going to school. This seemed to be taking my time for revision, and I was always tired that led me to sleep in class. I complain this to my mother, but she felt that I was lazy. This made me feel that I was being treated like an employee in my home. I decided that I was going to show a cold shoulder to my mother until I could be treated like others children. This went on for long and communication between my mother, and I seemed to be breaking completely. This was when my mother noticed that our relationship was deteriorating and asked my uncle to mediate.

My uncle was able to follow the procedures of mediation, and he started by asking me to define my problem and state my position.  He had to learn about the situation and our emotions first. Later, my uncle made each one of us understand what the other one was feeling about the issue (Hayes, 2017). This was done when my mother and I held separate talks with my uncle, and we just knew what the other felt about the issue through my uncle. My uncle seemed very conversant with conflicts within the family and knew how to handle the situations. Some suggestions saw us move closer each time to finding a resolution. Although my uncle would have been relieved and happy if we had a resolution faster, he gave us time and even listened to both sides without any favor (Gutman, 2017). He was able to give me the strengths of my stand as well as my weaknesses, and he did the same to my mother.  He made me realize that our family relied on us which meant that it would either fall or rise again. Eventually, my mother has to give in to some of the complains I had put across. She acknowledged that I had the rights to education and peace of mind without being bombarded with responsibility meant for adults.

Mediation gives a person a chance to weigh options (Moore, 2014 pg. 187). The step by step procedures give one a chance to see both sides and realize if he or she is in the wrong. Due to the slow process of mediation, there is eventually a well-thought solution. The first process of initiating mediation means that the two people are ready in need of a resolution. The lack of coercion makes a person feel the need of resolving the conflict which is from the heart hence having the capability of being a lasting solution.
